Important Information for Owners’ Management Companies (OMCs) and Property Management Agencies (PMAs) on Waste Management

Key Points:

  • Legal Obligations: Under waste management legislation, OMCs and PMAs are considered a ‘waste holder’ or a ‘person in charge,’ which has implications for how they must manage waste.
  • Enforcement: Failure to meet these legal obligations could result in enforcement action, including prosecution, by Dún Laoghaire-Rathdown County Council (DLRCC).
  • Dún Laoghaire-Rathdown County Council’s(DLRCC) Responsibilities: DLRCC is responsible for enforcing householders’ obligations to segregate waste and to keep food/organic waste separate from other waste streams.

Request for Information

To ensure that waste is being managed in accordance with relevant legislation, DLRCC is now requesting information from OMCs and PMAs pursuant to Section 18 of the Waste Management Act 1996 (as amended). This information is being collected via an electronic form available here.

Completing the Form:

  • You can access the electronic form using the provided link above.
  • A separate form must be completed for each Multi-Unit Development (MUD).
  • A paper copy of the form is available upon request, but the electronic form is the quickest and easiest way to submit the information.
  • It is imperative that you complete the form in its entirety, providing sufficiently detailed and clear information.

Consequences of Non-Compliance:

Failure to provide the necessary information may result in further follow-up investigations, including enforcement action under the Waste Management Act 1996, as amended.
