Key Points:

  • Legal Obligations: Businesses are legally required to ensure all waste, particularly hazardous and clinical waste, is managed in a safe and proper manner, preventing risks to human and animal health or the environment. This is mandated by the Waste Management Act 1996 (as amended).
  • Authorised Collectors: All hazardous and clinical waste generated on your premises must be collected by an authorized waste collector. A list of authorized collectors can be found on the National Waste Collection Permit Office (NWCPO) website at www.nwcpo.ie.
  • Hazardous Waste Regulations: Hazardous waste must be dealt with in line with the European Communities (Shipments of Hazardous Waste Exclusively Within Ireland) Regulations 2011 (S.I. No. 324 of 2011) and must be accompanied by a Waste Transfer Form (WTF).
  • Enforcement: Dún Laoghaire-Rathdown County Council (DLRCC) is responsible for enforcing these regulations. Failure to comply can result in enforcement action, including fines and/or imprisonment.

To ensure businesses are managing waste in accordance with relevant legislation, DLRCC may request information under Section 18 of the Waste Management Act 1996 (as amended). This request will specifically seek details about your waste collection and disposal services, particularly regarding any hazardous and clinical waste generated by your business.
