Intro Text 

Dún Laoghaire-Rathdown County Council, in its role as Planning Authority, lodged Amendment No. 8 to An Bord Pleanála to amend the Cherrywood SDZ Planning Scheme 2014 (as approved) on Tuesday, 1st June 2021. 

The purpose of the proposed amendment is to amend the approved Planning Scheme to take cognisance of the review undertaken by the Cherrywood Development Agency Project Team (DAPT) arising from the requirements of the SPPR 3 (B) of the Ministerial Guidelines ‘Urban Development and Building Heights, Guidelines for Planning Authorities, December 2018.

Having regard to Section 170(A) of the Planning and Development Act 2000 (as amended), DLRCC as Planning Authority and the Development Agency for the Cherrywood Planning Scheme requested An Bord Pleanála to amend or initiate the amendment process for the Cherrywood Planning Scheme in accordance with the documents below as Proposed Amendment No.8 to the Cherrywood Planning Scheme.

An Bord Pleanála, as the relevant Competent Authority, determined on 17 February 2022 that the proposed amendment comprising a building height and density review would constitute the making of a material change to the Planning Scheme. Dún Laoghaire-Rathdown County Council as the Planning Authority is hereby proposing to amend the Cherrywood Planning Scheme in accordance with the determination by An Bord Pleanála and Section 169 of the Planning and Development Act, 2000, as amended and are hereby undertaking the required statutory public consultation process.

This Proposed Amendment was considered at a Special Meeting of the County Council on 10 November 2022. It was agreed by resolution to make the proposed Amendment, but subject to modifications as per  Section 169 (4)(b) of the Planning & Development Act 2000 (as amended). This firstly requires further review and possible associated information gathering on the implications of the proposed modifications. Subsequently, reviews of said proposed modifications are required, particularly in the context of any associated material alterations. This is then to be followed by a further public consultation. The steps to undertake this review of the implications of the proposed modifications and associated screening is underway, and it is intended to proceed to public consultation in late December 2022.
